Terms of Service

These Terms of Service ("Terms") govern your access to and use of Profylio (the "Service"), operated by [YOUR FULL NAME OR BUSINESS NAME] ("Profylio," "we," "us," or "our"). By creating an account or using Profylio, you agree to these Terms.

If you do not agree, do not use Profylio.

1. Eligibility

You must be at least 18 years old to use Profylio. By using the Service, you represent and warrant that you are 18 or older. We reserve the right to delete any account we reasonably believe belongs to a minor.

2. Account Registration

• You may create an account using Apple Sign-In, Google Sign-In, or email and password.
• You are responsible for keeping your account credentials secure.
• You are responsible for all activity under your account.
• You agree to provide accurate information and to update it if it changes.
• One account per person. Multi-accounting and bot accounts are prohibited.

3. The Service

Profylio is an entertainment app that uses artificial intelligence to analyze user-submitted face photos and return a numeric score and tier classification ("Looksmaxxing" gamification). The Service includes social features such as following other users, posting scans, sending messages, and competing on leaderboards.

4. Important AI Disclaimer

Profylio's scores are for entertainment purposes only. They are generated by an AI model based on facial harmony patterns and are not a medical, psychological, or aesthetic diagnosis. Scores do not reflect any objective measure of human worth, attractiveness, health, or genetic value.

Do not rely on Profylio for any decision regarding your physical or mental health, plastic surgery, dating, employment, or any other consequential matter. We are not responsible for any consequences resulting from acting on or interpreting your scores.

5. User-Generated Content

You retain ownership of the photos, posts, comments, and messages you submit to Profylio ("Your Content"). However, by submitting Your Content, you grant Profylio a worldwide, non-exclusive, royalty-free, transferable license to host, store, reproduce, modify, display, and distribute Your Content solely for the purpose of operating and improving the Service.

You represent and warrant that:

• You own or have the necessary rights to all of Your Content.
• Your Content does not violate any third party's privacy, publicity, intellectual property, or other rights.
• You will only upload photos of your own face. Uploading photos of other people without their explicit consent is prohibited and may violate the law.
• Your Content complies with our Community Guidelines.

We may remove any content that violates these Terms or our Community Guidelines, at our sole discretion, without notice.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any local, national, or international law.
• Harass, threaten, intimidate, or stalk other users.
• Upload nudity, sexually explicit content, violence, gore, or content depicting minors.
• Impersonate any person or entity, or misrepresent your affiliation.
• Upload AI-generated, edited, or manipulated photos to inflate scores.
• Reverse engineer, decompile, or attempt to extract source code from the Service.
• Use bots, scrapers, or automated tools to access the Service.
• Interfere with or disrupt the Service's servers or networks.
• Attempt to gain unauthorized access to other users' accounts or our systems.
• Resell, sublicense, or commercially exploit the Service without our written permission.

7. Subscriptions and Payments

7.1 Plans

Profylio offers an optional Profylio Pro subscription with two billing options:

• Weekly: €4.99 / week, automatically renewing every week.
• Yearly: €39.99 / year, automatically renewing every year.

Prices may differ in your local currency and may change. We will notify you of any price changes before they take effect.

7.2 Billing

All payments are processed by Apple In-App Purchase (iOS) or Google Play Billing (Android). Your subscription is charged to your Apple ID or Google account at the start of each billing period. Profylio does not directly receive or store your payment details.

7.3 Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. To cancel, go to your iOS Settings → Apple ID → Subscriptions, or Google Play → Subscriptions.

7.4 Refunds

All refund requests must be submitted directly to Apple or Google through their standard refund processes. Profylio cannot issue refunds for in-app purchases.

7.5 EU Right of Withdrawal

If you are an EU consumer, you have a 14-day right of withdrawal under EU consumer law. By starting to use Profylio Pro immediately after subscribing, you expressly agree that the Service is provided in full and you waive your right of withdrawal once the Service has been accessed. Refunds in this case follow Apple's or Google's policies.

8. Intellectual Property

Profylio, the Profylio name and logo, the FIFA-style card design, the tier system, and all related software, designs, and content (excluding User Content) are the exclusive property of [YOUR FULL NAME OR BUSINESS NAME]. All rights reserved.

We grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the Service for your own non-commercial use, subject to these Terms.

9. Termination

You may delete your account at any time from within the app or by emailing profylio.app@gmail.com.

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, our Community Guidelines, or any applicable law. Upon termination, your right to access the Service ends immediately. Sections that by their nature should survive termination (including ownership, disclaimers, indemnification, and limitations of liability) will survive.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, error-free, or free of viruses or harmful components. We do not guarantee any specific score, tier, or outcome.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROFYLIO, ITS OPERATORS, AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid Profylio in the 12 months preceding the claim, or (b) €50.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In those jurisdictions, the above limitations apply only to the extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless Profylio, its operators, and affiliates from any claim, damage, loss, or expense (including legal fees) arising out of (a) your use of the Service, (b) your violation of these Terms, (c) Your Content, or (d) your violation of any third-party rights.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email. Continued use of the Service after changes means you accept the updated Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Germany, without regard to conflict-of-law principles. Any dispute shall first be addressed by good-faith negotiation. If unresolved, disputes shall be brought exclusively in the competent courts of Germany.

If you are a consumer in the EU, mandatory consumer protection laws of your country of residence still apply.

15. General

• If any provision of these Terms is held invalid, the remaining provisions remain in effect.
• Our failure to enforce any right is not a waiver.
• You may not assign these Terms; we may assign them in connection with a merger or acquisition.
• These Terms (together with our Privacy Policy and Community Guidelines) are the entire agreement between you and Profylio.

16. Apple-Specific Terms (iOS Users)

The following terms apply to your use of Profylio on Apple iOS devices. In the event of any conflict between these Apple-specific terms and the rest of these Terms, the Apple-specific terms control with respect to your use on iOS.

• Acknowledgment: These Terms are between you and Profylio only, not with Apple Inc. ("Apple"). Profylio, not Apple, is solely responsible for the Service and its content.
• Scope of License: The license granted to you for Profylio is limited to a non-transferable license to use the app on any Apple-branded device that you own or control, in accordance with the Apple Media Services Terms.
• Maintenance and Support: Profylio is solely responsible for providing any maintenance and support services. Apple has no obligation to provide any maintenance or support.
• Warranty: Profylio is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by applicable law, Apple has no warranty obligation whatsoever with respect to the app.
• Product Claims: Profylio, not Apple, is responsible for addressing any claims relating to the Service, including product liability claims, claims that the Service fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
• Intellectual Property Claims: In the event of a third-party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights, Profylio, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
• Legal Compliance: You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

17. Google-Specific Terms (Android Users)

If you use Profylio via the Google Play Store, you also agree to the Google Play Terms of Service. Profylio, not Google, is solely responsible for the Service.

18. Export Controls

You may not use, export, or re-export Profylio except as authorized by United States law and the laws of the jurisdiction in which the Service was obtained. In particular, but without limitation, the Service may not be exported or re-exported (a) into any U.S.-embargoed countries or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List.
